(a) (1) A written agreement or memorandum of understanding between the Board or the appropriate Federal Reserve Bank and the bank or bank holding company; (2) A temporary or final cease-and-desist order issued pursuant to section 8(b) or (c) of the FDIA (12 U.S.C. 1818(b) or (c)); (3) A condition for approval of an application or issuance of a notice of intent not to disapprove a proposal; (4) Or other similar means; or (5) The procedures set forth in paragraph (b) of this section.
