Clean Water Act Hazardous Substance Facility Response Plans: Compliance Date Delay and Changes To Reflect Administration Policy
Rule · 2026-10-13
· US
· Environmental Protection Agency
The Environmental Protection Agency (EPA) is finalizing an extension to the compliance date for Facility Response Plans (FRPs) required by the Clean Water Act (CWA) addressing potential worst-case discharges of CWA hazardous substances. These requirements apply to onshore non-transportation-related facilities that could reasonably be expected to cause substantial harm to the environment from a CWA hazardous substance worst-case discharge to navigable waters, adjoining shorelines, or the exclusive economic zone. This action is also finalizing language modifications to remove references to climate change and environmental justice in the FRP requirements to align with Executive Order 14148 of January 20, 2025. EPA is revising the compliance deadlines in light of serious concerns that facilities may be unable to comply with the relevant requirements by the existing deadline. These changes are necessary to allow the Agency to consider implementation and compliance assistance tools that regulated facilities may be able to take advantage of when complying with the new requirements, and to ensure proper planning for all communities while promoting a science-based and risk-based approach to planning. EPA also recognizes that a delay would provide time for EPA to consider whether revisions are necessary before facilities must comply.

Notice of Availability: Anchorage Terminal Area Airspace and Procedures Study for Review and Comment Period, and Workshop Announcement for the Draft Environmental Assessment
Notice · 2026-10-13
· US
· Transportation Department, Federal Aviation Administration
The FAA, in cooperation with the United States Air Force, is announcing the public review/comment period and public workshops for the ATAAPS DEA for the proposed Anchorage terminal airspace redesign. ATAAPS involves changes to the airspace, aircraft flight paths, and aircraft altitudes in the Anchorage basin and surrounding areas. The DEA evaluates the potential environmental impacts of the proposed airspace redesign (Proposed Action) and the No Action alternative. The FAA has not made a final decision on any airspace/procedure amendments related to the Proposed Action. A copy of the DEA, appendices, and the Workshop announcements will be posted to the FAA ATAAPS web page at: https://www.faa.gov/about/office_org/headquarters_offices/ara/ alaskan_region/ataaps. Early notification of the FAA's intent to prepare a DEA was published in the Federal Register on July 16, 2026 (91 FR 43723, FR Doc. 2026-14367). In accordance with the National Environmental Policy Act of 1969, 42 U.S.C. 4321 et seq., and in accordance with FAA Order 1050.1G, FAA National Environmental Policy Act Implementing Procedures, the FAA issues this notice that it has prepared a DEA for the ATAAPS project and has made it available for public review and comments. The ATAAPS Project would improve safety and efficiency of the National Airspace System (NAS) and homeland defense capabilities, by optimizing aircraft arrival and departure procedures that serve multiple airports--specifically in the Anchorage basin and surrounding areas--including: Ted Stevens Anchorage International Airport (ANC), Elmendorf Air Force Base Airport (EDF), Bryant Army Airfield Airport (FRN), Lake Hood Airport (LHD), and Merrill Field Airport (MRI). As a critical strategic gateway for homeland defense, Joint Base Elmendorf-Richardson (JBER) is currently restricted from operating at its intended capacity and fleet mix until the surrounding airspace is officially modified. The Instrument Landing System (ILS) for Runway 17 is integral to improving JBER operations, but cannot become operational under the current airspace design. (JBER runway designations are currently 16/34 and 06/24; Runway 16/34 will be updated due to Magnetic Variation changes to Runway 17/35 before completion of the Final Rule).

Privacy Act of 1974; System of Records
Notice · 2026-10-13
· US
· Federal Housing Finance Agency
In accordance with the requirements of the Privacy Act of 1974, as amended, (Privacy Act), the Federal Housing Finance Agency (FHFA or Agency) is proposing to modify an existing system of records currently titled, "Transit Subsidy Program Records, FHFA-11." This system of records will consolidate and incorporate the records previously maintained in the "Parking Program Records, FHFA-12" system of records, 76 FR 33294 (June 8, 2011). Effective upon publication of this notice, FHFA will maintain all transit benefit and parking program records within the revised FHFA-11 system of records to streamline recordkeeping, eliminate duplicative systems, and reflect current program operations. As part of this consolidation, FHFA-12 is being formally rescinded and all relevant information maintained within that system is integrated into the updated FHFA-11 SORN. FHFA-11 contains documentation, to the extent not covered by any other system, pertaining to employees who apply for and receive parking and transit subsidy program benefits for use in parking at or commuting to their official duty station whether by commercial or public transit systems, or by bicycle. The records are used to administer the FHFA transit subsidy and parking program to determine eligibility; process applications; verify enrollment; track benefits and manage employee participation; facilitate and track reservations for government vehicles; and facilitate coordination with transit authorities, benefit administers, and the payroll office. The proposed modifications include revising the: (1) title of the system; (2) system security classification; (3) system location; (4) system manager; (5) legal authorities for maintenance of the system; (6) purpose of the system; (7) categories of individuals covered by the system; and (8) categories of records maintained in the system. Changes also include the revision and addition of routine uses; removal of the Disclosure to Consumer Reporting Agencies section; and updating the policies and practices for storage of records, the policies and practices for the retrieval of records, the policies and practices for the retention and disposal of records, and the administrative, technical, and physical safeguards. Revisions also include minor updates for clarity and consistency.

In accordance with the requirements of the Privacy Act of 1974, as amended, and Office of Management and Budget (OMB) Circular No. A-108, "Federal Agency Responsibilities for Review, Reporting, and Publication under the Privacy Act," the Federal Housing Finance Agency (FHFA or Agency) proposes to rescind an existing System of Records Notice (SORN). The SORN being rescinded, "Parking Program Records, FHFA-12," was originally published on June 8, 2011, and amended on October 8, 2015. This system of records contains information used to administer the Agency's parking program. In order to streamline FHFA's program administration and ensure consistent management of similar categories of records, the Agency is consolidating its parking program records with its transit subsidy records. Both systems of records will be maintained under the SORN FHFA-11, which is being simultaneously revised and retitled "Transit Subsidy and Parking Program Records, FHFA-11."
